CANCELLATIONS + BOOKINGS General:

A booking Reservation Fee is payable to reserve your session time in our calendar.

We value our time and expect our clients to value it too. Your reservation Bookin Fee/Deposit is securely collected from you if you book online or over the phone. It’s our way of ensuring clients attend their dedicated session time that is planned especially for them.

The booking fee is not refundable if clients do not attend their photography session nor is it refundable if a client does not purchase artwork. Sara Kiyork Photography may choose to credit the booking fee to any image purchase in accordance with a particular photography campaign.

1. In the event you need to postpone your shoot for unforeseen circumstances we allow for 1 postponing appointment with the booking fee. We appreciate 24 hours notice but understand emergencies do arise.

2. In the event of cancellation your booking fee is not refunded.

PRINT SHOP

Products

We commit to describing/presenting each artwork accurately. However, please note the colour viewed on-screen may depend on your computer system and/or display monitor. We can not guarantee that your computer will accurately display the true colours seen on-screen to what is delivered in print.

Returns

We do not offer refunds or exchanges on photography prints or frames once an order has been placed.

If you believe your product has a defect or has been damaged in transit, please email us within 48 hours of the item being received. Depending upon the issue, we may request you to provide photographic evidence showing the stated damage to the product and the packaging so we can notify our courier company. If faulty goods are received, we will replace it or provide a full refund. After 48 hours of the item being received we do not take responsibility for the products condition.

Please ensure you open your package as soon as it is received, in order to check the condition of the design and packaging. We do not take responsibility for damages caused to product(s) by how the packaging is opened by the recipient or damages caused by the recipient(s) or the recipient(s) property/mailbox.

Care & Maintenance

When hanging your print, please display out of direct sunlight and away from areas of high temperature and humidity. We recommend reading a guide to hanging your print to ensure quality and longevity.

USE OF IMAGES

Sara Kiyork owns the copyright to all images taken in the course of engaging photographic services. By engaging Sara Kiyork Photography the client understand that some images may be used for professional portfolio use unless otherwise requested. All privacy requests will be honoured.

GALLERY DELIVERY

Images are kept on file 28 days post purchasing  in the event clients wish to add to their orders.

Images in your Portrait Collection will be available for re-order (and another viewing session available) for 12 months following your session, only when your original order is $1000 or more. If you need to view your photos again, we will book you in for a complimentary purchasing appointment. Re-orders are subject to the prices current at the time. If your original order is less than $1000, only the images you order will be kept on file, and the rest will be purged 28 days post purchasing appointmnet. Sara Kiyork takes every precaution when archiving your images, however cannot be held liable if something happens to the image files that is beyond their control. Archives will be kept for the lifespan of media (currently external hard-drives).

IMAGE DELIVERY

1. Digital File collections are delivered via online gallery with a download PIN. Sara Kiyork Photography reserves the right to delete galleries 28 days from time of email delivery. It is the client's responsibility to ensure their images have been received and are downloaded within the 28 days of notice.

FAMILY PORTRAIT GIFT CARDS

1. Any offers or specials are for a FULL family group portrait session.

2. All images and products included in the offer / special must also be a full family portrait and all of the same portrait.

3. All adults must attend both the photography session and purchasing appointment to claim full value of certificate

4. Session must be booked prior to expiry date stated in your email.

5. All ordered images are removed after the collection of your artwork.

6. Design appointment is to be completed within 2 weeks from your photography session to redeem your gift certificate..

7. Only one gift certificate per family, per year may be used.

8. Offer and GIFT CARD is not transferable. Any offers may not be used in conjunction with any other offer or certificate and is not redeemable for cash or any other goods and may only be used as described. Offer not transferable.

9. Special offers cannot be used to purchase portraits from a previous portrait session.

PERSONAL INJURY DURING SESSION

10. Sara Kiyork photography sessions are quite active and involve physical activity. Any injuries need to be told to the photographer prior to the session. This is undertaken at your own risk.

POST EDITING AND IMAGE DLIEVERY

11. Digital files included in any specials, will contain all purchased images at high resolution, fully retouched and cropped as per your order. Any other requirements will be charged at $50 per image. In the digital package “best images” means images that you order.

12. All family promotions are not for commercial use.

13. Management reserves the right to refuse service at anytime.

15. All images and products included in a single offer or special, must be a full family / single portrait and all of the same portrait.

16. We respect your privacy and personal information is not shared with any third party or other organisations unless client provides express permission in writing.

17 . Gift certificates for specific limited projects and limited photographic offerings are valid 90 days from issue. Sara Kiyork Photography reserves the right to extend validity. All other Gift Certiticates are valid for 3 years.

We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). This policy sets out how we collect and treat your personal information.

1.2. “Personal information” is information we hold which is identifiable as being about you.

2.2. You may provide basic information such as your name, phone number, address and email address to enable us to send information, provide updates and process your product or service order. We may collect additional information at other times, including but not limited to, when you provide feedback, when you provide information about your personal or business affairs, change your content or email preference, respond to surveys and/or promotions, provide financial or credit card information, or communicate with our customer support.

2.3. Additionally, we may also collect any other information you provide while interacting with us.

Sara KiyorkPhotography Photography collects personal information from you in a variety of ways, including when you interact with us electronically or in person, when you access our website and when we provide our services to you. We may receive personal information from third parties. If we do, we will protect it as set out in this Privacy Policy.

4. USE OF YOUR PERSONAL INFORMATION

4.1. Sara Kiyork Photography may use personal information collected from you to provide you with information, updates and our services. We may also make you aware of new and additional products, services and opportunities available to you. We may use your personal information to improve our products and services and better understand your needs.

4.2. Sara KiyorkPhotography may contact you by a variety of measures including, but not limited to telephone, email, sms or mail.

5.1. We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this Policy. Personal information is only supplied to a third party when it is required for the delivery of our services.

5.2. We may from time to time need to disclose personal information to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request.

5.3. We may also use your personal information to protect the copyright, trademarks, legal rights, property or safety of Sara KiyorkPhotography www.sarakiyork.com.au its customers or third parties.

5.4. Information that we collect may from time to time be stored, processed in or transferred between parties located in countries outside of Australia.

5.5. If there is a change of control in our business or a sale or transfer of business assets, we reserve the right to transfer to the extent permissible at law our user databases, together with any personal information and non-personal information contained in those databases. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. We would seek to only disclose information in good faith and where required by any of the above circumstances.

Where we disclose your personal information to third parties, we will request that the third party follow this Policy regarding handling your personal information.

6.1. Sara KiyorkPhotography is committed to ensuring that the information you provide to us is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.

6.2. The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us, or receive from us. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.

7. ACCESS TO YOUR PERSONAL INFORMATION

7.1. You may request details of personal information that we hold about you in accordance with the provisions of the Privacy Act 1988 (Cth). A small administrative fee may be payable for the provision of information. 7.2. We reserve the right to refuse to provide you with information that we hold about you, in certain circumstances set out in the Privacy Act.

8. COMPLAINTS ABOUT PRIVACY

8.1. If you have any complaints about our privacy practices, please feel free to email details of your complaints to studio@sarakiyork.com.au We take complaints very seriously and will respond shortly after receiving written notice of your complaint.

9.1. Please be aware that we may change this Privacy Policy in the future. We may modify this Policy at any time, in our sole discretion and all modifications will be effective immediately upon our posting of the modifications on our website or notice board. When you come to our website (www.sarakiyork.com.au) we may collect certain information such as browser type, operating system, website visited immediately before coming to our site, etc. This information is used in an aggregated manner to analyse how people use our site, such that we can improve our service.
